THE STRATEGY FOR PASSING THE PATENT BAR EXAM DRAMATICALLY CHANGED ON APRIL 2, 2013

For the ten years prior to April 2, 2013, it was possible to pass the patent bar exam (100 question multiple choice exam) primarily by memorizing old test questions and answers from 1999 to 2003 made available by the U.S. Patent & Trademark Office (USPTO).  This material was supplemented by more recent Q & As that were shared on Internet blogs by some students who had recently taken the bar exam.

That all changed on April 2, 2013. The USPTO announced that the content of the bar exam would be updated to reflect the America Invents Act and that anyone taking future exams would be required to sign an agreement prohibiting their disclosure or transmitting the content, or substantially similar content, of the bar exam in whole or in part.

This non-disclosure requirement has dried up all useful information on blogs other than confirmation that the percentage of old familiar questions has been substantially reduced.

Fortunately, the USPTO’s long standing guidance remains in effect. That is, all of the correct answers to questions on the patent bar exam can be found in the USPTO’s Manual of Patent Examining Procedure (MPEP) and related Supplemental Materials that will be made available during the examination. In effect, this means that the patent bar exam continues to be an “open book exam”. This also means that the only practical way to pass the bar exam is to master this material. (Merely memorrizing flash cards with old Q &As is no longer a viable alternative.)

The catch is that the “open book” contains approximately 3,000 pages. So, test takers must learn to become extremely efficient in searching for correct answers during the limited time allowed for the exam.
